The Federal High Court in Ikoyi, Lagos, has struck out a lawsuit filed by Winhomes Estate Global Services Limited against the Attorney General of the Federation and four others, ruling that the court lacked jurisdiction and the plaintiffs had no legal standing.
The decision, delivered by Justice Akintayo Aluko on November 21, 2025, also dismissed the case for failing to disclose a reasonable cause of action.
The dispute centered on a parcel of land along the Lagos shores, which Winhomes had sold to third parties despite it being earmarked for the Lagos-Calabar Coastal Highway project.
The Federal Ministry of Works had offered compensation, but the company refused to vacate the land, insisting the highway’s route be altered. After demolishing a gatehouse on the property, Winhomes sued, prompting the court’s ruling.
The judge cited Section 251 of the Constitution, noting the claims involved land use and trespass outside the court’s jurisdiction. Winhomes’ admission that it no longer owned the land further weakened its case.
The Ministry of Works welcomed the verdict, calling it a closure to malicious campaigns against the Honourable Minister and officials.
The court’s decision underscores the government’s stance on protecting public infrastructure projects from private interests.
